DRIVER, J. -- While John Looney was walking across a street in Seattle, on or near an intersection crosswalk, he was struck and mortally injured by an automobile driven by Herbert Baumgartner. The plaintiff, in her capacity as administratrix, brought this action for the decedents wrongful death for the benefit of his four surviving minor sons. A trial before a jury resulted in a verdict for the defendant Herbert Baumgartner, the only defendant appearing in the action. Plaintiffs motion for a new trial was denied, and from a judgment of dismissal, she has taken this appeal.
